Welcome to Sunray Academy of Canada (referred to as “Sunray Academy,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our online educational services, courses, and learning management system (“LMS”) platform (collectively, the “Services”). By enrolling, accessing the LMS, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. Eligibility and Enrollment
1.1 General Eligibility: Enrollment in Sunray Academy’s courses is available to students worldwide.
1.2 Account Registration: You must register with a valid email address to access our Services. Each account is unique to a single individual. Sharing login credentials with others is strictly prohibited.
1.3 Accuracy of Information: By registering, you represent that all information you provide is truthful, accurate, and complete. You agree to keep this information current and updated.
2. Free Trial Period
2.1 Free Trial Access: Sunray Academy may offer a free trial of up to seven (7) days for select courses. During the free trial, you will have limited access to course content and the LMS.
2.2 Free Trial Limitations: During the free trial period, students are not permitted to submit assignments, receive teacher feedback, get assignments graded, or earn credits toward course completion. The free trial is designed solely for previewing course materials.
2.3 One-Time Use Policy: The free trial can only be redeemed once per student, per course, and tied to a single, unique email address. If you have previously accessed the free trial for a particular course, you will not be eligible for another free trial for the same course using the same or a different email.
2.4 Marketing and Communications: By signing up for the free trial, you consent to receiving emails and other communications from Sunray Academy regarding trial updates, payment instructions, and marketing materials. You may opt out of marketing communications at any time by following the unsubscribe instructions provided in the email, though we may still send non-marketing messages related to your account or transactions.
3. Tuition, Fees, and Payment
3.1 Tuition and Fees: All course fees must be paid in full prior to gaining full course access beyond any free trial period. Fees are subject to change without notice, and the current fees will be stated on the Sunray Academy website or enrollment portal at the time of registration.
3.2 Payment Methods: We accept payment through the methods listed during checkout. You agree to pay all applicable fees promptly and in full. Any failure to process payment may result in loss of access to course materials.
3.3 Additional Fees: Tuition fees cover all costs associated with each course. However, additional fees may apply for international documentation, equivalent credit assessments, or other specialized services. Please contact us directly for more information.
4. No Refund Policy
4.1 No Refunds: Upon registration, Sunray Academy incurs expenses, so there will be NO refunds after that point. Within 7 days of registration, if no work has been submitted in the original course, students can transfer to another available Sunray Academy course with a request in writing. Prerequisites are required for the course to which they wish to transfer, and only one course change is allowed.
5. Prerequisites and Waivers
5.1 Prerequisite Requirements
5.1.1 Definition: Certain courses offered by Sunray Academy require the successful completion of prerequisite courses before a student can progress to the next academic level. Prerequisites are determined in accordance with standards established by the Ontario Ministry of Education.
5.1.2 Responsibility to Verify: Students are responsible for verifying and meeting all prerequisite requirements before registering for a course. Course outline pages will indicate whether a prerequisite is required.
5.1.3 Submission of Evidence: Upon enrollment, students must provide official documentation demonstrating that they have satisfied the prerequisite requirements. Acceptable forms of evidence include an official Ontario Student Transcript, a final report card, or a credit counselling summary.
5.1.4 Submission Process: Prerequisite evidence should be submitted to [info@sunrayacademy.ca] promptly after enrollment to ensure timely access to the course.
5.2 Prerequisite Waivers
5.2.1 Eligibility for Waivers: Students who have previously acquired relevant knowledge and skills closely aligned with the curriculum of a prerequisite course may be eligible for a prerequisite waiver. This may apply to international or out-of-province students, mature students, homeschooling families, and individuals with equivalent workplace or experiential learning.
5.2.2 Application Process: To request a waiver, students must complete and submit a Prerequisite Waiver Application along with all supporting documentation. The student may be asked to complete the prerequisite course’s final exam as a demonstration of knowledge.
5.2.3 Approval and Registration: The waiver application must be reviewed and approved by Sunray Academy before the student can complete the course registration process. If approved, the student may proceed without fulfilling the listed prerequisite.

5.3 Compliance and Enforcement
5.3.1 Accuracy of Information: By submitting prerequisite or waiver documentation, students affirm that all information provided is accurate and truthful. Providing falsified or misleading information may result in dismissal from the course and forfeiture of any fees paid.
5.3.2 Final Determinations: Sunray Academy reserves the right, at its sole discretion, to accept or reject any prerequisite evidence or waiver request based on our academic standards and policies.
6. Course Start and Completion
6.1 Asynchronous Start: Through our asynchronous learning structure, students may begin courses as soon as they are ready. There are no start-date deadlines, allowing enrollment at any time throughout the year.
6.2 Completion Timeline: Students complete courses at their own pace. Courses must be completed within a maximum of twelve (12) months from the date of enrollment. There are no set due dates for assignments or tests, so students have flexibility in managing their personal schedules, whether they choose to work rapidly or more gradually to meet their individual goals.
7. Course Content and Intellectual Property
7.1 Proprietary Rights: All course content, materials, videos, assignments, and LMS features are the exclusive intellectual property of Sunray Academy or its licensors. You are granted a limited, non-transferable, non-exclusive license to access and use the course content for personal, non-commercial educational purposes only.
7.2 Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content, except as authorized in writing by Sunray Academy.
7.3 Academic Integrity: You agree to uphold high standards of academic integrity. Unauthorized collaboration, plagiarism, and cheating are strictly prohibited and may result in termination of your enrollment without refund.
8. Student Conduct and Suspension
8.1 Code of Conduct: Students must behave respectfully and ethically while using the LMS and interacting with instructors, staff, and other students. Offensive, discriminatory, or harassing behavior will not be tolerated.
8.2 Suspension or Expulsion: Sunray Academy reserves the right to suspend or remove any student from a course or the LMS if they violate these Terms, engage in misconduct, or otherwise impede the learning environment. In such cases, no refunds or credits will be provided.
9. Technology and LMS Access
9.1 Access and Downtime: While we strive to maintain uninterrupted access to the LMS, technical issues, maintenance, or other factors may cause temporary service disruptions. Sunray Academy will not be liable for any losses or refunds due to downtime.
9.2 Student Responsibility: You are responsible for ensuring you have the necessary equipment, software, and internet access required to use the LMS. We do not guarantee compatibility with all devices or systems.
10. Disclaimer of Warranties and Limitation of Liability
10.1 No Guarantee of Results: Sunray Academy does not guarantee that you will earn any credit, certification, or achieve any particular outcome by using our Services.
10.2 As-Is Basis: Our Services are provided “as is” and “as available” without any warranties of any kind, either express or implied.
10.3 Limitation of Liability: To the fullest extent permitted by law, Sunray Academy, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Services, even if advised of the possibility of such damages.
11. Changes to Terms
11.1 Modification of Terms: Sunray Academy reserves the right to update or modify these Terms at any time. We will post the most recent version on our website, and the “Last Updated” date at the top will reflect the date of the most recent changes. Your continued use of the Services after changes have been made constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
12.2 Dispute Resolution: Any disputes arising from or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of an established arbitration provider in Ontario. Each party shall bear its own costs.
